Ordering and delivery terms

The owner of the online store elektikas.ee (hereinafter referred to as the Online Store) is STRAT OÜ (registry code 14627694), located at Mõisavahe tn 46-116, 50708 Tartu, Tartu County.

Validity of the sales contract, product and price information

The terms and conditions of sale apply to purchases made in the online store.

The prices of products sold in the online store are indicated next to the products. A delivery fee will be added to the price. All prices of goods sold in the online store are in euros.

The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer when placing the order.

Information about the goods is provided in the online store directly next to the goods.

Placing an order

To order goods, add the desired products to your shopping cart. To complete your order, fill in the required fields and select the appropriate delivery method. The total amount will then be displayed on the screen, which can be paid securely using the following payment methods:

  • Estonian bank payments
  • Visa/Mastercard card payments
  • Apple Pay and Google Pay
  • Pay later solutions

NB! When paying via bank link, be sure to click on the „Back to merchant“ button on the bank's page.

Payments are processed by LHV. Payment takes place outside the online store in a secure environment – when paying by bank link, in the secure environment of the respective bank, and when paying by credit card, in a secure environment. The seller does not have access to the customer's bank and credit card details. The contract enters into force upon receipt of the amount payable in the online store's settlement account.

The owner of the online store is the controller of personal data and transfers the personal data necessary for making payments to the authorized processor.

If the ordered goods cannot be delivered due to stock depletion or other reasons, the buyer will be notified as soon as possible and the money paid (including delivery costs) will be refunded immediately, but no later than 14 days after the notification is sent.

Delivery

Goods are shipped to the following countries: Estonia

The buyer has the following options for receiving the goods:

  • Coming up in Tartu
  • Omniva parcel terminal
  • Smartpost parcel terminal

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.

STRAT OÜ will ship the ordered goods within 2–5 business days after the payment has been received in the bank account of STRAT OÜ. If the ordered goods are not in stock in Estonia or the order cannot be fulfilled within 2–5 business days for some other reason, the store will notify the buyer. The store is not responsible for delays in the delivery of goods to the buyer caused by the postal service provider.

In exceptional cases, goods may be delivered within up to 45 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods may not be used in any way other than is necessary to ascertain the nature, characteristics, and functioning of the goods, as is permitted when testing goods in a physical store.

If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods, or if they show signs of use or wear and tear, the Online Store has the right to reduce the refund amount in accordance with the decrease in the value of the goods.

To return goods, you must submit a statement of withdrawal from the purchase, the form for which can be found from here and send it to the email address shop@elektrikas.ee no later than 14 days after receiving the goods.

The costs of returning the goods shall be borne by the buyer, except in cases where the reason for the return is that the product to be returned does not correspond to the order (e.g., incorrect or defective product).

The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.

The online store shall refund the buyer immediately upon receipt of the returned goods, but no later than 14 days after receiving the notice of withdrawal, all fees received from the buyer under the contract.

The online store may refuse to make refunds until it has received the item that is the subject of the contract or until the buyer has provided proof that they have returned the item, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the online store, the online store is not required to reimburse the consumer for any costs exceeding those associated with the standard delivery method.

The online store has the right to withdraw from the sale and demand that the buyer return the goods if, due to an error, the price of the goods in the online store is significantly lower than the market price.

Right to file a claim

The online store is liable for any non-compliance with the terms of the contract or defects in the goods sold to the buyer that already existed at the time of delivery and become apparent within two years of delivery to the buyer. Within one year of delivery to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the online store to refute this presumption.

In the event of a defect, the buyer has the right to contact the online store within two months at the latest by sending an e-mail to shop@elektrikas.ee.

The online store is not responsible for defects that have arisen after the goods have been delivered to the buyer.

If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all fees associated with the sales contract.

The online store shall respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The online store forwards personal data to companies providing transport services in order to deliver the goods.

The online store will send newsletters and offers to the buyer's email address only if the buyer has expressed a desire to do so by entering their email address on the website, checking the box, and indicating their desire to receive direct mail notifications.

The buyer can opt out of receiving offers and newsletters sent by e-mail at any time by notifying us by e-mail or by following the instructions provided in the e-mail containing the offers.

Dispute resolution

If the buyer has any complaints regarding the online store, they should be sent by email to shop@elektrikas.ee.

If the buyer and the online store are unable to resolve the dispute by mutual agreement, the buyer may refer the matter to the Consumer Disputes Committee. The terms and conditions of the procedure can be found and a statement can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between buyers and online stores. The committee reviews buyers' complaints free of charge.
